Privacy from the perspective of Imam Khomeini and Iran's constitutional rights with a comparative view on women's ascension

Abstract

Beauty is in human nature and therefore makeup and adornment has always been and is the concern of man. The Holy Qur'an also directly refers to the issue of Tabarj in two surahs, Al-Ahzab and Noor; Tabraj is placed in the circle of privacy and the inherent right of every human being; This right is done with various means and methods such as: clothes, perfumes, hair and face makeup, etc. In fact, the right to privacy is the domain of the actions of every person who may not want to reveal it. However, it should be known that although privacy is a human right, all the rights and freedoms of individuals are not absolute and free, and in fact, the law or custom that confirms privacy also considers it limited and conditional. Some insist on the individuality of the veil and consider it a matter outside the scope of the government and the people of the society; But this claim is rejected for some reasons; Because, on the one hand, it is not possible to separate the private from the public realm in some cases, and on the other hand, the effectiveness of veiling on the mental health of the society and the critical treatment of hijab in the regulations of Western and even Westernized Islamic countries, show this issue as a social and public issue. The analysis of Imam Khomeini's opinion, commentators and even some jurists indicate that the scope of women's tabraj is wider than the expression of adornment and make-up in clothing, and in general, any kind of display of women that leads to the commission of a sin is considered tabraj
