Analysis and Elucidation of the Nature of Sharia Hijab from the Perspective of Right and Ruling

Abstract

One of the issues that is nowadays raised as a question and doubt regarding hijab is
whether hijab, like alimony (nafaqah), is a "right" of women and women are free in fulfilling it, or whether it is a divine ruling like khums and zakat, with its reins in the hands of God, and women are obligated to observe it. Although good scientific efforts have been made regarding the concept, definition, characteristics, and differences between "right" and "ruling," and valuable works have been published on this issue, no significant research was found specifically on whether hijab is a right or a ruling. The present research aims to fill this gap and answer the aforementioned question by examining this issue from the perspective of the Quran. Using a descriptive-analytical method, with evidences from verses and narrations, it has proven that hijab is one of the divine rulings, not women's rights; therefore, women are obligated to observe hijab in public view, not free to choose hijab or uncover it.
